Our private Client department at Thomas Boyd Whyte has been assisting the local community since our firm was established in 1946 in the preparation of Will and administration of estates where someone has died. It is pivotal to the success and longevity of our firm. The majority of our clients have recommended us to other family members or friends and come back to us for assistance as their family solicitors. We offer skilled and sympathetic solicitors who are specialists in making Wills, offering advice on Inheritance Tax Planning and obtaining probate to an estate of a deceased person. We also offer specialist advice on Enduring Power of Attorney and new lasting Powers of Attorney. Our services include advising on applications made to the Court of Protection for Receivership in respect of people who have become mentally incapable and can no longer manager their financial affairs.

 
 
PROBATE AND THE ADMINISTRATION OF ESTATES
We specialise in obtaining a Grant of Probate or if the deceased has died without a Will, a Grant of Letters of Administration, in order to deal with the distribution of the deceased assets to entitled beneficiaries.
 
WILLS AND INHERITANCE TAX PLANNING
We specialise in the preparation of Wills to ensure that on your death, your estate is administered by executors of your choice and to ensure that your Property and possessions pass safely to the people or charities whom you have chosen. You can appoint legal guardians for your children in the event you die whilst your children are under the age of 18 years. The preparation of a Will is particularly important for unmarried couples and people who have no next-of-kin . We offer free storage of your Will in our extensive safe storage facilities.
 
SERVICES FOR THE ELDERLY

Our specialist solicitors deal in all aspects of advice to the elderly, to include the lasting Power of Attorney, Enduring Powers of Attorney, applications for Receivership to the Court of Protection in respect of individuals who have lost mental capacity to deal with their own financial affairs. We offer home visits to the disabled and elderly and have full disabled access facilities on the premises.

 
DEEDS OF VARIATION
We can draft a Deed of Variation which can enable the terms of the deceased person’s Will to be varied so that the estate can be reorganised in a more tax efficient way in order to minimise Inheritance Tax liability within 2 years of an individual having died.
 
CONTENTIOUS PROBATE
We have a team of experienced specialist solicitors who deal with contentious probate dispute. In the event that a dispute arises over a deceased person’s estate, our litigation department can advise accordingly.
